Terms & Conditions, Permission to be Photographed, Usage:

This agreement is between you the “Client” or “Client(s)” and “MPaparazzo LLC” also referred to as “Photographer”.

By securing your time slot, the Client(s) agrees to the following terms:

MODEL RELEASE: The client(s) hereby grant to MPaparazzo unrestricted right to use and publish photographs of the client. This includes, but is not limited to, social media posts, website, Instagram, printed materials, etc.

COVID: Client assumes all COVID-associated risk. MPaparazzo will do its best to maintain CDC safety standards by sanitizing surfaces, limiting client interaction and having hand sanitizer available for use.

HEALTH AND WELLNESS: All clients are asked to screen themselves and their children for cough, fever, and other symptoms related to sickness before your session. MPaparazzo reserves the right to refuse to admit clients who appear to be experiencing symptoms, for the safety of everyone in attendance.

PAYMENT SCHEDULE: The total session fee (plus any chosen upgrade, plus tax) is due at time of scheduling your photography session or signing this agreement. This is a NON-REFUNDABLE PAYMENT that secures your session date with MPaprazzo. At the time the contract takes effect, MPaparazzo shall reserve the date and time agreed upon. For this reason, in the event that the Client cancels the contract for any reason, all monies paid shall be retained by MPaparazzo in order to offset loss of business. Session is non-transferable to another date/time, but may be gifted or sold. Please notify MPaparazzo if you will not be attending your session. In the event there is a government mandated closure that keeps us from holding sessions, your session fee is transferrable toward a future session with MPaparazzo, but it is non-refundable.

IMAGES and COPYRIGHTS: The photographs produced by MPaparazzo are protected by Federal Copyright Law and may not be reproduced in any manner. Purchased images may be used only for personal use and may not be edited, altered, or sold. Raw, unedited files are not available at any time.

Client authorizes the Photographer, and/or any assignees and licensees, to use and to create images, and any reproduction of them in any form in any media whatsoever, for promotional materials, online marketing, portfolio, and other areas of marketability.  Client also consents to the use of the Client’s own name or any fictitious name, which may be chosen in connection with the aforesaid photographs. 

Client acknowledges that the Client will not be compensated, either now or at any time in the future, for any use of marketing and that the Photographer of such photos exclusively owns all rights.  Client acknowledges and agrees that the Photographer may modify, change, or alter such images without restriction, unless outlined specifically in this Agreement.

Client acknowledges and agrees that the photographs created by the Photographer will become and remain the exclusive property of the Photographer, and that the Client retains no rights to said photographs unless specified particularly in this Release. Client waives all rights and claims and releases the Photographer from any claim or cause of action, whether now known or unknown, relating to the sale, display, license, use, and exploitation of the photos.

LIMIT OF LIABILITY: MPaparazzo takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond MPaparazzo control, MPaparazzo's liability is limited to a refund of monies paid. MPaparazzo is not liable for injury or damage to Clients before, during, or after the photo shoot. Therefore, the client releases MPaparazzo and Marianna Olshtein from being held responsible or liable for any injury or damage to any Client or guardian. No compensation in any form will be given to client by MPaparazzo or Marianna Olshtein, as it is ultimately the responsibility of the Client to ensure their safety at all times.

By reserving your spot, you agree to all of the terms within this contract.
